Client Data & Media Usage Policy

This Client Data & Media Usage Policy (“Policy”) governs the collection, storage, use, retention, licensing, and disposition of client data and creative media produced by DFW Pro Photographers (“DFW Pro Photographers,” “we,” “us,” or “our”), a business operated by Corporate Shutter LLC, doing business as DFW Pro Photographers. This Policy supplements our Privacy Policy and Terms of Service and forms part of our contractual relationship with clients.

By engaging our services, submitting materials, or receiving deliverables, clients acknowledge and agree to the terms set forth herein.

1. Definitions

For purposes of this Policy, “Client Data” includes all personal, business, technical, and project-related information provided by or obtained in connection with a client engagement. “Media” includes all photographs, images, drafts, edits, proofs, metadata, derivatives, and related creative works produced by DFW Pro Photographers. “Deliverables” refers to final, approved media provided to the client pursuant to a written agreement.

2. Ownership of Media

All Media produced by DFW Pro Photographers remains the exclusive intellectual property of DFW Pro Photographers and Corporate Shutter LLC unless expressly transferred in writing. No ownership interest is conveyed to the client by virtue of payment, delivery, or possession of Deliverables.

Clients receive a limited, non-exclusive, non-transferable, revocable license to use Deliverables solely for the purposes specified in their applicable agreement.

3. Client-Provided Materials

Clients represent and warrant that they possess all necessary rights, permissions, and licenses for any materials, logos, trademarks, likenesses, locations, or content provided to DFW Pro Photographers. We are not responsible for verifying ownership or obtaining releases.

Clients indemnify and hold harmless DFW Pro Photographers from any claims arising from client-provided materials.

4. Authorized Use of Media by DFW Pro Photographers

Unless expressly restricted in writing, DFW Pro Photographers reserves the perpetual right to use Media for:

• Portfolio display

• Website and social media promotion

• Marketing and advertising

• Educational and training purposes

• Business development

• Industry submissions and awards

• Internal quality control

Such use may include publication in print, digital, and electronic formats without additional compensation.

5. Restricted or Confidential Projects

If a client requires confidentiality, non-disclosure, or restricted usage, such limitations must be documented in a signed written agreement prior to service delivery. Verbal requests or informal communications are not binding.

Absent a written restriction, standard usage rights apply.

6. Data Storage and Archiving

Client Data and Media may be stored using secure third-party and internal systems, including cloud storage, network-attached storage, and physical media.

Storage systems may include, but are not limited to:

• Google Drive

• Dropbox

• OneDrive

• Local servers

• Redundant backups

We reserve the right to migrate, reorganize, or consolidate data systems as necessary for business operations.

7. Retention Periods

Client Data and Media are retained indefinitely unless otherwise required by law or specified in writing.

Active project files are generally maintained in accessible form for a limited period following delivery. Thereafter, files may be archived, compressed, or transferred to long-term storage.

We are not obligated to maintain indefinite active access to archived materials.

8. Client Access and Retrieval

Clients are responsible for downloading and securing Deliverables within the access period specified in their agreement or online gallery.

Requests for retrieval of archived materials may be subject to administrative fees, retrieval costs, and processing delays.

We do not guarantee availability of archived files indefinitely.

9. Data Modification and Deletion Requests

Requests to modify, restrict, or delete Client Data or Media must be submitted in writing.

Deletion requests are subject to:

• Contractual obligations

• Legal retention requirements

• Backup and archival limitations

• Legitimate business interests

Certain records may be retained notwithstanding deletion requests.

10. Use of Data for Business Improvement

We may analyze anonymized or aggregated Client Data and project metrics for internal research, workflow optimization, service development, and performance evaluation.

Such use does not identify individual clients unless expressly authorized.

11. Third-Party Platforms and Distribution

Media may be delivered or hosted through third-party platforms. Once delivered, we are not responsible for third-party security, access controls, data loss, or policy changes.

Clients are responsible for complying with third-party platform terms.

12. Transfer of Rights and Licenses

Clients may not sublicense, resell, assign, or transfer usage rights without prior written consent.

Unauthorized commercial redistribution constitutes material breach.

13. Limitation of Liability

To the maximum extent permitted by law, DFW Pro Photographers shall not be liable for loss, corruption, unauthorized access, or deletion of Client Data or Media beyond commercially reasonable safeguards.

Our total liability relating to data or media shall not exceed amounts paid for the applicable project.

14. Compliance With Law

We comply with applicable federal and state laws governing data protection, intellectual property, and privacy.

Clients are responsible for ensuring their intended use complies with applicable regulations.

15. Policy Modifications

We reserve the right to modify this Policy at any time. Updates will be posted on our website and become effective upon publication.

Continued use constitutes acceptance.
